Plain-English summary. MapShifter is an indie map app inspired by video-game cartography. The art is ours; the map data is open. Don't use MapShifter as your only way to navigate in situations where failure is dangerous. Don't try to reverse-engineer it. If something goes wrong, our liability is capped. Everything below is the formal version.

1. Agreement

These Terms of Service ("Terms") form a binding agreement between you and MapShifter ("MapShifter", "we", "us") regarding your use of the MapShifter mobile application, its Apple Watch companion, widgets, and the website at mapshifter.com (collectively, the "Service"). By installing, launching, or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.

You must be at least 13 years old (or 16 in the EEA) to use the Service. If you're using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. License to use

Subject to your compliance with these Terms, MapShifter grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the Service on Apple devices you own or control, for your personal, non-commercial use.

Your use of the App is also governed by Apple's Standard End User License Agreement ("Apple EULA"). Where these Terms and the Apple EULA conflict, the stricter restriction controls. You acknowledge that:

MapShifter, its logo, the word mark, the custom map skins, typography, icons, illustrations, and the compiled app binary are the property of MapShifter and protected by copyright, trademark, and other laws. The license in Section 2 gives you rights to use the App; it does not transfer any ownership to you.

6. Inspiration, not affiliation

MapShifter includes visual themes "inspired by" the look and feel of popular video-game cartographies. MapShifter is an independent project and is not affiliated with, endorsed by, or sponsored by any of the game studios, publishers, or franchise owners referenced (including, without limitation, Rockstar Games, Take-Two Interactive, Mojang Studios, Microsoft, Bethesda Softworks, ZeniMax Media, CD Projekt, or any of their affiliates). Each skin is original artwork and typography that pays homage to a broader cartographic style. All trademarks, trade names, and third-party intellectual property remain the property of their respective owners.

7. Third-party data and attribution

The underlying geographic data in MapShifter is provided by OpenStreetMap contributors under the Open Database License (ODbL). Map tiles are rendered via MapLibre from styles we author; routing is provided by Project OSRM; search and geocoding by Photon and Nominatim; place information by the Wikimedia Foundation. 8. Feedback

If you send us suggestions, bug reports, or feature requests, you grant MapShifter a perpetual, irrevocable, worldwide, royalty-free license to use them in any way, without obligation or credit. This keeps us free to build from user ideas without back-and-forth on ownership.

9. Purchases and refunds

Where the App offers paid features or unlocks, payment and receipts are handled by Apple through the App Store. Refunds, subscription cancellations, and family-sharing rules are governed by Apple's policies — please request refunds via reportaproblem.apple.com. We don't process card data ourselves.

10. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. MAPSHIFTER DISCLAIMS ALL WARRANTIES INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, ACCURATE, OR AVAILABLE IN YOUR AREA.

Map data, routing, traffic conditions, place information, and POI coverage come from third-party open-data sources and may be incomplete, outdated, or inaccurate. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

MapShifter is a supplemental navigation aid. It is not certified for emergency, aviation, marine, or commercial-vehicle routing. Always use your own judgment, obey traffic laws, watch the road, and do not operate a vehicle while interacting with the App. If a route instructs a maneuver that conflicts with posted signage, road conditions, or common sense, trust the road and ignore the App. MapShifter is not responsible for your driving, your delivery times, or where you physically end up.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MAPSHIFTER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, REGARDLESS OF THE LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total aggregate liability arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amount you paid MapShifter in the twelve months preceding the event giving rise to the claim, or (b) fifty US dollars ($50 USD). Nothing in these Terms limits liability that cannot be limited under applicable law (including, where relevant, liability for gross negligence, wilful misconduct, or death or personal injury caused by negligence).

13. Indemnification

You agree to defend, indemnify, and hold harmless MapShifter from any claim, liability, loss, or expense (including reasonable legal fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of any third-party right.

14. Termination

You may stop using the Service at any time by uninstalling the App. We may suspend or terminate your access if you materially breach these Terms. Sections that by their nature should survive termination (including Sections 4, 5, 8, 10, 12, 13, 16) will survive.

15. Changes to these Terms

We may update these Terms from time to time. If a change is material, we'll update the "Last updated" date above and surface the change in the App or on this site. Continued use of the Service after the change takes effect means you accept the updated Terms.

16. Governing law and disputes

These Terms are governed by the laws of your country of residence with respect to consumer-protection rights that cannot be waived, and otherwise by the laws of the jurisdiction in which MapShifter's principal place of business is located, without regard to conflict-of-law principles. You and MapShifter agree to try to resolve any dispute informally by emailing support@mapshifter.com first. Nothing in these Terms restricts your right to bring a claim in the courts of the jurisdiction where you live, where applicable law permits.
